Welcome to Phonout, developed by KnowPhone. These Terms and Conditions ("Terms") govern your access to and use of our mobile application, website (www.phonout.com), and related services. By downloading, installing, or using Phonout, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our services.
These Terms apply to all users who create accounts and use the app.
1. Acceptance of Terms
By accessing or using Phonout, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.
Age Requirement: 18+
You must be at least 18 years old to create an account and use Phonout. By creating an account, you confirm that you are 18 years of age or older.
- • Parents/guardians are responsible for monitoring their children's use of devices where the app is installed
- • You agree to use the app lawfully and in accordance with these Terms
- • You agree to provide accurate and complete information during account registration
2. Description of Service
Phonout is a screen time management application designed to help parents reduce their children's device addiction and promote healthy digital habits.
Key Features:
- • Google account authentication and user management
- • Personalized experience with playlists, queues, and watch history
- • PIN-protected screen locks to control device access
- • Customizable time limits for daily screen usage
- • Automatic lock overlay when time expires
- • Progress tracking and detox journey management
- • Multi-device support (phones, tablets, TVs)
- • Cloud sync for account data and parent activity
We reserve the right to modify, suspend, or discontinue any feature of the service at any time without prior notice.
3. User Accounts and Registration
To use Phonout, you must create an account using Google authentication.
Account Requirements:
- • You must sign in using your Google account
- • You must provide accurate information (name, email, phone number)
- • You must be at least 18 years old
- • You may not create multiple accounts or share accounts with others
- • You are responsible for maintaining the security of your account credentials
PIN Security:
- • You are responsible for maintaining the confidentiality of your 4-digit PIN
- • You must not share your PIN with unauthorized persons
- • You are responsible for all activities that occur under your PIN and account
- • If you suspect unauthorized access, change your PIN immediately
Account Termination:
- • You may delete your account at any time through the app settings or by contacting us
- • Account deletion will permanently remove all cloud-stored data (name, email, phone, playlists, queues, watch history) within 30 days
- • Local data (PIN, detox sessions) will remain on your device until you uninstall the app
- • We reserve the right to suspend or terminate accounts that violate these Terms
4. Subscription and Billing
Free Service
Phonout is currently offered as a free service with no subscription fees, advertisements, or data selling.
Future Premium Features
If we introduce premium features in the future:
- • Subscriptions will be processed through Google Play Billing
- • All payment information is handled by Google Play (we never store payment details)
- • Subscriptions automatically renew unless cancelled before the renewal date
- • Refunds will be subject to Google Play's refund policy
- • Pricing and features will be clearly communicated before purchase
5. Acceptable Use Policy
You agree NOT to:
- • Use the app for any unlawful or prohibited purpose
- • Attempt to bypass, disable, or tamper with the app's security features or screen locks
- • Reverse engineer, decompile, or attempt to extract source code
- • Share, distribute, or resell the app without authorization
- • Use automated systems (bots, scrapers) to interact with the service
- • Upload malicious code, viruses, or harmful content
- • Impersonate others or provide false information
- • Use the app in a way that could harm, disable, or impair our servers
- • Create accounts using automated means or under false pretenses
Violation of this policy may result in immediate account termination and legal action.
6. Parental Responsibility
Phonout is a tool to assist parents in managing screen time, but ultimate responsibility rests with you.
- • You are responsible for supervising your child's device usage
- • You must configure the app appropriately for your child's age and needs
- • You are responsible for ensuring the app does not interfere with emergency access (e.g., 911 calls)
- • We are not liable for any harm resulting from improper use or configuration
- • Children's data (detox sessions, preferences) is stored locally on your device and is your responsibility to manage
7. Intellectual Property Rights
Our Rights
All content, features, and functionality of Phonout are owned by KnowPhone and protected by:
- • Copyright laws
- • Trademark laws
- • Patent laws
- • Other intellectual property rights
Your License
We grant you a limited, non-exclusive, non-transferable, revocable license to use Phonout for personal, non-commercial purposes, subject to these Terms.
Your Content
You retain ownership of any data you input into the app (playlists, queues, watch history). By using our services, you grant us a limited license to store and process this data solely to provide the service.
8. Privacy and Data Collection
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.
Key Privacy Points:
- • We collect account information (name, email, phone, profile picture) via Google authentication
- • We store parent activity data (playlists, queues, watch history) in Firebase Firestore
- • Children's data (detox sessions, screen time settings) remains local on your device
- • Most data (PIN, sessions, preferences) is stored locally on your device
- • We do not sell your data to third parties
- • We use Firebase for minimal cloud sync and analytics
- • Payment data is handled exclusively by Google Play (we never access it)
9. Disclaimers and Limitations of Liability
"As Is" Service
Phonout is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
No Guarantees
We do not guarantee:
- • That the app will be error-free, uninterrupted, or secure
- • That defects will be corrected immediately or at all
- • That the app will meet your specific requirements
- • That screen time limits will solve behavioral issues
- • That the app cannot be bypassed by determined users
Limitation of Liability
To the maximum extent permitted by law, KnowPhone and its affiliates shall not be liable for:
- • Any indirect, incidental, special, or consequential damages
- • Loss of profits, data, or goodwill
- • Damages arising from use or inability to use the service
- • Damages caused by misuse or improper configuration
- • Any third-party actions (e.g., Google Play billing issues)
Our total liability shall not exceed the amount you paid us in the last 12 months (currently $0 for free users).
10. Indemnification
You agree to indemnify, defend, and hold harmless KnowPhone, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
- • Your use or misuse of Phonout
- • Your violation of these Terms
- • Your violation of any third-party rights
- • Any content or data you submit or share through the app
- • Your child's actions on devices where the app is installed
11. Third-Party Services
Phonout integrates with third-party services:
- • Google Authentication: For account sign-in and management
- • Firebase (Google): For cloud sync, analytics, and authentication
- • Google Play Billing: For subscription payments
These services have their own terms and privacy policies. We are not responsible for their practices or any issues arising from their use. By using Phonout, you also agree to comply with their terms.
12. Device Compatibility and Requirements
- • Phonout requires certain Android/iOS versions and permissions to function
- • You are responsible for ensuring your device meets the minimum requirements
- • Some features may not work on all devices or operating system versions
- • Internet connection is required for Google authentication, account sync, and cloud features
- • We are not liable for compatibility issues or device-specific problems
13. Termination
Your Right to Terminate
You may stop using Phonout at any time by:
- • Deleting your account through app settings
- • Uninstalling the app from your device
- • Contacting us to request account deletion
Our Right to Terminate
We may suspend or terminate your access to Phonout:
- • For violation of these Terms
- • For fraudulent or illegal activity
- • For abusive behavior toward our team or community
- • If we discontinue the service
- • For any reason, with or without notice
Effect of Termination
- • Your license to use Phonout will end immediately
- • Your account data will be deleted according to our Privacy Policy
- • Local data will remain on your device until app deletion
- • Provisions regarding liability, indemnification, and dispute resolution will survive termination
14. Changes to Terms
We reserve the right to modify these Terms at any time:
- • Changes will be posted at www.phonout.com/terms
- • Material changes will be communicated via in-app notification or email
- • Your continued use of the app after changes constitutes acceptance
- • If you disagree with changes, you must stop using the app and delete your account
- • We will update the "Last Updated" date at the top of this page
15. Governing Law and Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Jurisdiction
Any disputes arising from these Terms or your use of Phonout shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.
Informal Resolution
Before initiating formal legal proceedings, we encourage you to contact us at contact@knowphone.in to resolve disputes informally.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and KnowPhone regarding your use of Phonout and supersede all prior agreements and understandings.
